The Incident

On 10 December 2014, more than 100 demonstrators marched through Oakland and Berkeley, protesting the grand jury decisions not to indict the white police officers who killed the two unarmed black men Michael Brown and Eric Garner in Missouri and New York. As told by freelance photographer Michael Short, two undercover police officers were marching among the 50 odd people near Lake Merritt (Oakland) just after 11:30 p.m., when some of the demonstrators began calling out the two men saying they were undercover cops. After a brief scuffle, when crowd started surging on them and his partner was attacked, one undercover police officer aimed his gun at protesters and panned the crowd.

A man accused of punching one of the officers was booked into county jail, and another protester was arrested on suspicion of public intoxication. The undercover cop was a California Highway Patrol officer who was attempting to infiltrate a demonstration against police brutality in Oakland. Earlier in the week, protestors in the area threw rocks at police and shut down a major freeway, also devolving into vandalism and looting.

Secret Police Tactic

Explaining the incident, the chief of CHP’s (California Highway Patrol) Golden Gate Division, Avery Browne disclosed that the agency and other police departments have been using such undercover cops dressed in protester attire since the first demonstration on 24 Nov. 2014. Browne said that the two officers were able to collect enough information to prevent four more freeway shutdown attempts before they were outed. Despite the incident, the chief said that they will continue to employ same undercover tactic.

Police Instigated Vandalism?

The freelance photographer who was present at the site, Michael Short said that the two police officers were wearing street clothes and had their faces covered with bandannas. Many protesters at the incident who took to Twitter said that the officers had actually instigated acts of vandalism, looting and were banging on windows alongside others. Because the protestors had surrounded him, Michael Short said he could not see the officers’ actions. Another freelance photographer, Noah Berger was similarly accosted by protesters. Avery Browne said he has not received reports that the officers instigated vandalism. So it is unclear whether or not the undercover cops instigated protesters into vandalism and looting, and who started the scuffle initially before the cop drew gun at protestors.

Oakland and Berkeley have had a history of social activism, while the current protest was to condemn police brutality and the lack of indictments.
